Welcome to Sugar Sugar™. These Terms & Conditions (“Terms”) govern your access to and use of our websites, apps, services, franchises, and communications, including SMS messaging under 10-digit long code (10DLC). By engaging with Sugar Sugar services (including booking, purchase, messaging, or franchising), you accept and agree to these Terms.

 

1. Definitions

  • Company / We / Us / Sugar Sugar™: Sugar Sugar Franchise Systems, LLC and its subsidiaries.

  • You / Customer / User: Any person or entity using our services, websites, or messaging.

  • Services: Our beauty, sugaring, spray tan, facials, products, booking tools, and mobile / SMS communications.

  • SMS / Messaging: Text messages sent under our 10DLC-registered campaigns.

 

2. Use of Services & Eligibility

  • You must be 18 years or older (or the age of majority in your jurisdiction) to enter into these Terms.

  • You agree to use the Services in compliance with all applicable local, state (including Arizona), and federal laws.

  • You must provide accurate name, contact, and payment information when using our Services.

 

3. Appointment, Payment, Cancellation & Refunds

  • Payment for services or products must be made as required at booking or at service time.

  • Cancellation or rescheduling must occur within our posted policy (e.g., 24-hour notice) or a cancellation fee may apply.

  • Refunds are granted only in accordance with our refund policy published on our site and in location notices.

  • Any prepaid, membership, or package services must be redeemed within the timeframe stated (e.g., 9 months) and cannot be transferred to others unless expressly allowed in writing.

 

4. Intellectual Property Rights

  • All trademarks, logos, brand names, and content provided by us (e.g. “Sugar Sugar™”, “Authentic Skin™”) are our exclusive property.

  • You may not use, reproduce, or otherwise exploit our intellectual property without prior written permission.

 

5. Limitation of Liability & Disclaimers

  • To the fullest extent permitted by law, we are not liable for consequential, incidental, punitive, or special damages arising from use of our Services.

  • Our Services are provided “as is” and without warranties of any kind—not guaranteeing error-free performance or uninterrupted access.

  • Some states (including Arizona) may not allow disclaimers or limitations of certain damages, so parts of this section may not apply to you.

 

6. SMS / 10DLC Messaging Terms & Compliance

To ensure compliance with carrier and regulatory standards, especially 10DLC rules, the following terms apply:

  • You must opt in explicitly to receive SMS messages from us (e.g. via web form, keyword, or written consent).

  • By opting in, you agree to these Terms and our Privacy Policy.

  • Message frequency may vary (we may send appointment reminders, promotional alerts, service updates).

  • Message & data rates may apply per your mobile plan. We are not responsible for carrier charges.

  • To opt out, reply STOP (or equivalent keywords). After opt-out, we will send a confirmation and cease further communications.

  • For help, reply HELP or contact us at [support contact].

  • We will not share your mobile number for marketing without your further consent.

  • These Terms and our Privacy Policy must appear as a link or disclosure wherever phone number collection occurs.

  • SMS messaging campaigns must adhere to the content, volume, and registration requirements imposed by 10DLC and The Campaign Registry (TCR) to avoid blocking or penalties.

7. Governing Law & Dispute Resolution

  • These Terms and all related matters are governed by the laws of the State of Arizona, without regard to conflict of law principles.

  • You agree that any legal dispute arising under or related to these Terms will be filed in a court in Maricopa County, Arizona, or a federal court in Arizona.

  • Before filing suit, parties will attempt informal resolution in good faith for at least 30 days.

 

8. Changes to Terms

  • We reserve the right to modify or update these Terms at any time.

  • We will post the updated version on our website with a new “Last Updated” date.

  • Continued use of Services after changes constitutes acceptance of the revised Terms.

 

9. Miscellaneous Provisions

  • If any provision here is held invalid or unenforceable, the remainder will continue in full force.

  • Our failure to enforce a right will not constitute waiver of that right.
